ATMOPC SRLs, (hereinafter "ATMOPC"), makes available to all users the ability to purchase products via the Internet ATMOPC brand, (hereinafter "Products") via the website http://ecommerce.atmopc.com (the "Site"), of which ATMOPC it is the only and exclusive owner.
1) General notes
These General Terms and Conditions ( "Terms") are regulated by the Consumer Code (Legislative Decree. N. 206/2005, as amended) and the rules on electronic commerce (Legislative Decree. N. 70/2003 and amended) and apply only to the sale at a distance by means of the displayed products on http://ecommerce.atmopc.com web site at which there is the button "Add to cart", and Services as set forth in these Terms . In case of changes of the General Conditions, purchase order, as specified in the following articles. 3:04 of the General Conditions (the "Purchase Order") will apply the General Conditions published on the website at the same time the Order by the Customer (hereinafter "Customer").
2) Public offering
The Products and Services with their prices as in the Site constitute an offer to the public in accordance with the procedures set out in the General Conditions and in the Site. The conditions of this offer only apply to purchases made on the website indicated above. The purchasing contracts concluded on the Website and concerning the Products and Services (hereinafter "Purchase Contracts" or simply "Contracts") concluded with ATMOPC S.r.l.s ..
All prices of the products reported on the site, include VAT. The delivery costs (hereinafter "Delivery costs") and costs in connection with any further Services available from ATMOPC, as indicated in the following articles of these General Conditions, shall be borne by the customer and adequately detailed in the Order of Purchase. The Products and Services to apply the price shown on the site, at the time the Order, without any consideration of previous bids or any changes might occur price.
Purchase Orders must be made online through the order process (the "Procedure Order") on the Site. In order to proceed to the compilation of the Customer Purchase Order shall follow the following procedures:
a) In the event that the customer is already registered to the site will simply enter their login credentials (username and password) by placing them in the Section "LOGIN."

The Client correctly concludes Procedure Order if the site does not show any error message (the system can not detect errors in reference to the data entered by the customer in the field dedicated to the addresses for billing and shipping).
The Purchase Agreement will be concluded between ATMOPC and the Customer at the time of receipt of the Order by ATMOPC. In this case ATMOPC shall acknowledge receipt of the Order by sending an e-mail confirmation of the order (the "Order Confirmation") to the email address supplied by the customer. Confirmation that summarize the products and services selected, the relative prices (including the costs of delivery and additional expenses related to additional services requested by the customer), the address for delivery, the order number (hereinafter "Number d 'Order'), the General Conditions of Sale therein and any special conditions applicable to each Order and determined pursuant to specific customer requirements.
ATMOPC reminds the Customer to check with the utmost care and attention to the correctness of the data contained in the Order Confirmation and notify ATMOPC within 24 (twenty four) hours of receipt of the corrections. The Order Number, generated by the system and communicated by ATMOPC, will be used by the Customer in any communications with ATMOPC.
You may experience occasional non-availability of the products offered, in this case, if the products chosen by the customer are not, in whole or in part, available, ATMOPC will notify customer.
Payment Order must be paid at the time the Order itself to ATMOPC.
The payment must be done on-line with Credit Card and / or PayPal, following the instructions on the Site
ATMOPC will issue invoice for the Purchase Order, sending it via e-mail to the subject holder of the Order. In the event that, within fifteen (15) days from the confirmation of the Order, the holder of the Order has not received such invoice by e-mail, the same may contact ATMOPC at the following link "Contact Us". For a printed invoice, they will prevail on the information provided by the customer. ATMOPC therefore reminds the Customer to always check with the greatest attention, the accuracy of the information provided.
6) Delivery Mode
ATMOPC delivers the goods (hereinafter "Delivery Service" or simply the "Delivery") edited by the employees specialized carriers from ATMOPC (hereinafter "Carriers"). At the time of delivery is required of the customer or the presence of a trusted person to check that the packaging is intact and clean and that the products received correspond to the information on the Order. In case of visible defects, such as incorrect quantity and / or incorrect product as broken packaging, ATMOPC asks the customer or a person in whom he trusts you to make the reporting of these anomalies on the delivery note and contact ATMOPC to link "" Contact ".
ATMOPC Delivery Products purchased at the address specified by the customer, within 30 (thirty) days from the Order, as follows:
a) Orders of which the weight is equal to or less than 50 (fifty) kg - ( "Light Truck"): at the time of placing the Order will indicate the date Estimated Delivery. That date is purely indicative, therefore, no responsibility can be attributed to ATMOPC in case of a failure to comply with the same where the delivery takes place within 30 days from the Order
The delivery will be made by courier working between 8.00 and 19.00 Monday to Friday. The Carrier will do n. 1 (one) attempt to deliver the products to the address specified by the customer. In case of absence at the delivery the Carrier will send the customer a notice by e-mail with details of the phone number to call, or the link to be selected to arrange the second delivery. After the second attempt was successful we will be sent to the customer a new e-mail. The Products will be still kept in storage for free by the Carrier for n. 10 (ten) days (calendar), from the date of submission by the Airline of each of the two e-mail communications above, during which the customer can contact him for further agreements. After n. 10 (ten) days (calendar) of storage, the Order will be automatically canceled and ATMOPC will provide notice to Customer of cancellation with repayment of the value of the Order of the same reduced delivery costs, which will be borne by the customer.
b) orders that they weigh more than 51 (fifty) kg - ( "Transport by appointment"): at the time of placing the Order will indicate the date Estimated Delivery. That date is purely indicative, therefore, no responsibility can be attributed to ATMOPC in case of a failure to comply with the same where the delivery takes place within 30 days from the Order. Subsequently, the customer will be contacted directly by us to agree the time slot and the day he will be made the delivery. If the customer needs to change the date of delivery already agreed with the Carrier, may do so free of charge up to 24 (twenty four) hours before the time slot previously agreed. To fix a new delivery, the Customer may contact the Carrier from Monday to Friday 9.00-18.
The delivery costs (hereinafter "Delivery Charges") are charged to the customer and adequately in the Purchase Order and subsequent order confirmation highlighted and detailed.
For each mode of delivery, as indicated in art. 6), ATMOPC applies the following costs:
a) The cost of the delivery service for orders whose weight is less than or equal to 50 (fifty) kg, as per letter. a) art. 6 above (Light Transport), ranges of a minimum of Euro 20.00 (twenty / 00) to a maximum of Euro 91,00 (ninety / 00).
b) The cost of the delivery service for orders whose weight is greater than or equal to 51 (fifty) kg, as per letter. a) art. 6 above (Light Transport), ranges of a minimum of Euro 91,00 (ninety / 00) to a maximum of Euro 201.00 (two hundred and one / 00)
8) Support Services for Information and Complaints
The customer can get information about the support services, including after-sales service, as well as for the forwarding of claims (the "Customer") services by contacting ATMOPC through the channels listed in the "Contact us" of the Site.
9) Cancellation of Purchase Order
If the customer wishes to cancel his order, will proceed with the cancellation within 24 (twenty four) hours from payment, at no additional cost. In this case ATMOPC will refund the customer the full amount paid by reimbursement to the same channel used for the payment, minus the bank charges relating to the return.
10) Right of withdrawal
If the customer is a "consumer", as defined in Article 3 of the Consumer Code, the rights set out in ART.52 et seq. of the Consumer Code, as amended by Legislative Decree 21 of 02/21/2014, and therefore the right to terminate the Purchase Agreement (the "Withdrawal Right") for any reason, without explanation and without penalty, in the manner set out below.
The withdrawal will be designed to all (Withdrawal Total) or only part (Partial Withdrawal) of the Products and / or Services ATMOPC purchased by the consumer.
In the case of products, the period of withdrawal shall expire after 14 (fourteen) days from the day when the consumer or a third party other than the Carrier and indicated by the consumer acquires physical possession of the / of the Goods / or (the "Period withdrawal ").
In the case of services, the withdrawal period expires after fourteen (14) days from the day of conclusion of the contract (the "Withdrawal Period").
The right of withdrawal is exercised by sending - before the expiration of the withdrawal period as indicated above - of a notice of withdrawal (the "Withdrawal Notice") by regular mail addressed to:

The Notice of Withdrawal may alternatively be sent - within the same period of withdrawal as just quoted - even by e-mail at the following address: firstname.lastname@example.org. The Withdrawal Notice must specify the intention to withdraw from the purchase and the product / service or the products / services for which it intends to exercise the right of withdrawal.
Following the proper exercise of the right of withdrawal, as outlined in Article. 52 et seq. of the Consumer Code as just mentioned, ATMOPC will forward to the Consumer, through E-MAIL Number of Practice. This number will be indicated by the Consumer upon return of the / the product / s (the "Refund"). The Return of / the product / s shall take place within 14 (fourteen) days from the date on which the consumer has communicated its decision to want to withdraw pursuant to art. 52 of the Consumer Code just mentioned. This stipulated period will be met if the consumer sends back or return the / the Goods / or the subject of withdrawal before the 14 day deadline. The Consumer shall return the / the product / s by providing the relevant shipment.
ATMOPC reminds its consumers that the transport costs for return of the / the product / the object of withdrawal shall be borne by the consumer and that the Restitution is under the full responsibility of the consumer himself. ATMOPC also reminds his Consumers, before the Restitution, to check that the / the product / the object of withdrawal is / are intact / s and in the normal state of preservation, inserted in the original package, complete in all its parts (including packaging and ancillary documents). ATMOPC reminds its Consumers that in case of withdrawal exercised within 24 hours of completion of the contract, the consumer will not be burdened by the costs of returning the / the product / the subject of withdrawal.
The Consumer, under current legislation, be liable only to the decrease of the / value of the product / s resulting from the / manipulation of same / different from the one required to establish the nature, characteristics and functioning of the / i Product /the.
If the right of withdrawal has been properly exercised in accordance with Articles. 52 et seq., ATMOPC will reimburse the Consumer the full amount paid, inclusive of delivery charges and any and all additional costs incurred within 14 (fourteen) days from the date on which it was informed of the decision of the consumer to withdraw the Purchase Agreement. The amount will be refunded by the same means of payment used by the consumer for the initial transaction, unless expressly different request of the consumer and provided that the consumer does not incur any fees as a result of the repayment. ATMOPC, pursuant to art. 56 of the Consumer Code, as amended by Legislative Decree n. 21/2014, reserves the right to withhold the reimbursement until he has received the / the products / or or until the consumer has supplied evidence of having sent the / the products / or, depending on which situation occurs first. This power will not be applied to ATMOPC if the Consumer for the / i Product Return / s has made use of the transport service dedicated to the Return and made available by ATMOPC.
In case of payment by financing, reimbursement shall be by the following method:
• In case of partial withdrawal. The Consumer can choose between the following options: refund - only and only if already paid by the consumer and up to the value of / the product / the object of Withdrawal
• In the event of a total withdrawal. Return only the amount and only if already paid by the consumer and up to the total amount due by the Consumer on purchases subject to total withdrawal.
11) Guarantees Legal and Conventional
a) Legal guarantee for the customer Consumer: The Consumer Client (hereinafter, "Consumer"), as defined in art. 3 of the Consumer Code (hereinafter, the "Consumer Code", Decree 6 September 2005, n. 206), has the right to seek legal guarantee provided by the Consumer Code same Articles from 128 to 132. This provides Warranty , among other things, that the consumer, subject to revocation, to denounce ATMOPC any lack of conformity found by the Consumer in purchased product within two (2) months from the discovery (art. 132 of the Consumer Code). Following this complaint, the consumer will be entitled to require repair or replacement of the product, without prejudice to any other rights provided by law in favor of the consumer. By virtue of the legal guarantee above, ATMOPC is responsible for any lack of conformity which becomes apparent within 2 (two) years from the product delivery. After this date ATMOPC therefore not be liable for any lack of compliances identified by the consumer. In the case of replacement or repair of the Product, the terms of the warranty on the product as a replacement, or resulting from repair, it is the same as the original product. Therefore, the total two-year legal warranty begins still from the original product delivery. To obtain Warranty recommend you to show the purchasing document. Reference is made, in any case, for the discipline of the legal guarantee, the rules of the Consumer Code referred to in Articles 128 and following.
b) Legal guarantee for the customer not consumer (Professional):
The Client Professional, as defined in art. 3 of the Consumer Code, has the right to seek legal warranty provided for in the Civil Code. This warranty provides, among other things, that the customer is not consumer, subject to revocation, to denounce ATMOPC any lack of conformity found in the product purchased within 8 (eight) days of discovery. The guarantee Legal above is valid for a maximum period of 12 (twelve) months from delivery of the Product. After this date ATMOPC therefore not be liable for any lack of compliances identified by the customer not consumer. To obtain Warranty recommend you to show the purchasing document.
The customer who buys an electrical or electronic product (the product) intended for domestic core can dispose of your old analogue product using the municipal ecological platform or, pursuant to Legislative Decree no. 49/2014, deposit it at any point of sale in ATMOPC Italy submitting your purchase of the new document within 90 days. The amount of equipment to be delivered will be higher than the amount of products purchased. Example: for the purchase of two computers, the client can request the collection of used up to a maximum of two computers. The product must have the same function as the product purchased, it should be complete in conditions which do not pose a safety risk for those who must move, without adding elements or foreign materials, not deprived of any of its components and of similar size compared to yours. If the product does not meet the above conditions, ATMOPC not withdraw.
Customer data are treated by ATMOPC accordance with the provisions of legislation on protection of personal data, as specified in the information provided in the section "Information according to art. 13 of Legislative Decree no. 30/06 / 2003 ".
Any communication, except as provided in art. 11 "Right of Withdrawal", will be directed to ATMOPC using the contact channels listed in the "Contact us" of the Site.
